SCOPE OF THIS POLICY
This privacy policy describes the treatment of information provided or collected on the sites and applications where this privacy policy is posted, whether on our digital properties or on applications we make available on third-party sites or platforms. We follow this privacy policy in accordance with applicable law in the places where we operate. In some cases, we may provide additional data privacy notices specific to certain products, practices, or regions. Those terms are to be read in conjunction with this policy.
Please keep in mind that when you provide information to us on a third-party site or platform (for example, via our applications), the information you provide may be separately collected by the third-party site or platform. The information we collect is covered by this privacy policy, and the information the third-party site or platform collects is subject to the third-party site or platform’s privacy practices. HOW WE COLLECT INFORMATION

• Registration information you provide when you create an account, enter a promotion, or link your profile on a third-party site or platform with your registration account, such as your first name and surname, country of residence, gender, date of birth, email address, username, and password;

• Information you provide in social media sites and applications, such as your public posts;
• Information sent either one-to-one or within a limited group using our message, chat, post, or similar functionality, where we are permitted by applicable law to collect this information;

HOW WE USE INFORMATION
• We collect information you provide to us when you request or purchase products, services, or information from us, register with us (including when you link your profile on a third-party site or platform with your registration account), participate in public forums or other activities on our sites and applications, respond to guest surveys, or otherwise interact with us using one or more devices. You may provide information in a variety of ways, including by typing or using voice commands.
• We collect information through a variety of technologies, such as cookies, Flash cookies, pixels, tags, software development kits, application program interfaces, and Web beacons, including when you visit our sites and applications or use our applications on third-party sites or platforms using one or more devices, whether or not you are logged in or registered.
• We collect information using analytics tools, including when you visit our sites and applications or use our applications on third-party sites or platforms.
• We acquire information from other trusted sources to update or supplement the information you provided or we collected automatically, such as when we validate postal address information using third party services. Applicable law may require that you authorize the third party to share your information with us before we can acquire it. Aesthetic Theory Medspa that is the data controller for your information is responsible for and may use your information for the purposes described in this policy.
• Provide you with the experiences, products, and services you request, view, engage with, or purchase;
• Communicate with you about your account or transactions with us and send you information or request feedback about features on our sites and applications or changes to our policies;
• Send you offers and promotions for our products and services or third-party products and services;

SHARING YOUR INFORMATION WITH OTHER ENTITIES
• We will not share your personal information with a third party outside the Aesthetic Theory Medspa except in limited circumstances, including:
• When you allow us to share your personal information with another company, such as:
◦ Electing to share your personal information with carefully selected companies so that they can send you offers and promotions about their products and services; and
◦ Directing us to share your personal information with third-party sites or platforms, such as social networking sites.
• Please note that once we share your personal information with another company, the information received by the other company is controlled by that company and becomes subject to the other company’s privacy practices.
• When companies perform services on our behalf, like package delivery, marketing and advertising, and customer service; however, these companies are prohibited from using your personal information for purposes other than those requested by us or required by law; and
• When we share your personal information with third parties in connection with the sale of a business, to enforce our Terms of Use or rules, to ensure the safety and security of our guests and third parties, to protect our rights and property and the rights and property of our guests and third parties, to comply with legal process, or in other cases if we believe in good faith that disclosure is required by law.
YOUR CONTROL OVER YOUR DATA
We provide you the ability to exercise certain controls and choices regarding our collection, use and sharing of your information. In accordance with applicable law, your controls and choices may include:
• Correcting, updating, and deleting accounts.
• Choosing or changing your choices for subscriptions, newsletters, and alerts;
• Choosing whether to receive from us offers and promotions for our products and services, or products and services that we think may be of interest to you;
• Choosing whether we share your personal information with other companies so they can send you offers and promotions about their products and services;
• Controlling targeted advertising from many ad networks and partners; data exchanges; and marketing analytics and digital advertising and marketing service providers.
• Choosing to control targeted advertising you receive within applications by using the settings and choices made available to you through your device(s), for example, by re-setting your device’s advertising identifier and/or opting out of interest based ads;
• Requesting removal of your personal information from a public forum on one of our sites or application; and
• Requesting access to the personal information we hold about you and that we amend or delete it.
Please be aware that if you do not allow us to collect personal information from you, we may not be able to deliver certain experiences, products, and services to you, and some of our services may not be able to take account of your interests and preferences. We take great pride in the relationship of trust we have built with our customers and we are dedicated to treating your personal information with care and respect. Pursuant to California Civil Code Section 1798.83(c)(2), Aesthetic Theory Medspa does not share customer’s personal information with others outside unless a customer elects that we do so. For more information about our privacy and data collection policies, you may wish to review our Privacy Policy.
If you are a California resident under the age of 18, and a registered user of any site where this policy is posted, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. To make such a request, please send an email with a detailed description of the specific content or information to
[email protected]. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and that there may be circumstances in which the law does not require or allow removal even if requested.
PRIVACY NOTICE AND AUTHORIZATION
Major changes in Federal privacy requirements - the HIPAA privacy regulations obligate most physician practices to provide notice about privacy rights and detailed policies designed to protect your privacy. These requirements were put into place because increased patient information is being shared in digital format over computer networks.
Aesthetic Theory Medspa is committed to protecting patient confidentiality. You should understand the following with regard to how we treat your personal health information:
1) When you register a new patient, you will be asked to sign an authorization, also provided below, that includes a release of information that allows us to request and obtain records from practitioners that you have seen for the purpose of assisting us in your treatment. If you desire records to be sent to a health provider you have not yet seen, a family member, an attorney, or other party outside of this list, you must first sign a release of information before we can forward your information. You may be subject to fees.
2) We cannot release information to family members, other than parents or legal guardians, even if they are involved in your care, without your written permission.
3) In order to assure quality care, Aesthetic Theory Medspa records are occasionally reviewed both internally and by outside consultants in legal, clinical, and other concerns that affect the quality of services we provide. Only necessary information is accessed, and any such review is by a professional staff working under the condition of confidentiality.
4) If you wish to limit the nature of information that is released, or the parties noted above to whom information may be provided, please ask to meet with an Aesthetic Theory Medpa privacy coordinator to discuss limitations. In some instances, Aesthetic Theory Medspa may not be in a legal position to honor requested limitations.
5) We may be required by law, in some cases, to make disclosure of your record that you have not authorized. Examples are subpoenas in criminal or civil litigation, or requests/surveys by licensure agencies of the US Department of Health and Human Services.
6) Because Aesthetic Theory Medspa is subject to HIPAA, Aesthetic Theory Medspa practices long established and useful business practices, such as providing you with appointment reminders notifying you of lab results, or using sign-up sheets, but we will take steps to do so in a fashion that takes your privacy expectations into account. Please inform staff of any limitations you would like us to honor in this regard.
7) Aesthetic Theory Medspa reserves the right to charge for copying and forwarding your health records.
8) While the records of the care we provide are Aesthetic Theory Medspa property, we will make them available for your inspection and provide copies at a reasonable fee. If you have any concerns about your health records, please ask to speak with an Aesthetic Theory Medspa Medical Staff member.
9) The patient will be offered the right to review the complete HIPAA compliance documents and understand that Aesthetic Theory Medspa will comply to protect my privacy.
